Premium info from other sites

Hale has complained in the past that some of his premium info gets posted on our board. So, if he says something on the radio, that's fine to post but if he says something on his website, plse do not post it over here unless you can confirm the information through another source. Thanks!

Why are you honoring his complaint. As long as people are not directly copying what he writes and posting it here the website is doing nothing wrong.

You are correct. But, just because we aren't doing anything in diect violation of the law, it doesn't mean you can't get sued. We just don't want to give him or anyone else a reason to file suit.

This is what I've understood as well, but want to be 100 percent sure. If there are any lawyers out there, or anyone with knowledge of internet copyright law, who can clear this up it would be appreciated.

I am not a lawyer. However, my understanding is that you cannot copyright a fact. For instance Felisha Gibbs commits to OU...that is a fact and James cannot copyright that. James can copyright the words he used to describe that fact but he does not have the exclusive right to convey that fact.

Hopefully a lawyer on the board can confirm my understanding is correct.

I would think that the problem is a moral one, not a legal one. Presumably, the way we get the information on our board is that someone who is paying to be a member of Hale's premium board sees the info and reposts it here. Unless that person signed a non-disclosure agreement as part of his premium board membership, there should be no legal issue.

On the other hand, James' annoyance is somewhat justified in that information that he went to some effort to obtain and is giving out only to people who had paid for the privilege, is now being redistributed to people who did not pay him.

I've observed the same thing with the Sherri Coale luncheons. I will tell you that back in the day, one could get all sorts of inside information at those luncheons. Now, as a result of the growth of message boards and some indiscrete posting of quotations, nothing is said in those luncheons that Sherri does not mind having repeated far and wide.
 
I understand Tango's point about it being a moral issue. But, I don't belong to any pay sites. I figured out a long time ago that iny information on the pay sites eventually makes it to the free sites.

So if someone posts something on another free board that I think will be of interest over here, I'll post it. Nine times out of ten, I have no idea where they got the information.

As long as people aren't quoting Hale's site word for word, I don't think he has a leg to stand on. He owns the words he writes, but he doesn't own the facts behnd those words.
