If they counted the transfer as an expense, it would lower net income to -$3.7mm.

The amount of excess $ the AD made is the difference ($3.7mm), not the sum.
 
I'll add to this:

It sounds like the $6.3 is simply a cash transfer. So it wouldn't be an expense. Which wouldn't change the $2.6M net income. It certainly wouldn't increase it, but it's likely that it's not an expense, and is simply a transfer of cash. That wouldn't change Revenue, Expenses, or Net Income.
If this is correct, then the athletic department had at least an additional $6.3M cash on hand. Not speaking for Boulder, but it sounded like he wanted to use those funds to pay off Porter instead of sending it to the university. Maybe his wording was off, but your attack is over the top.
