Lacedarius Dunn suspended indefinitely?

I'm pretty sure police are called for accidents all the time. Not that I am commenting on this particular case at all, of course. I know nothing about it.
 
Exactly what I thought as well when I read that. How exactly does Dunn accidently break her jaw? Sure, accident my ass. Daddy is making some money trying to save Dunn's rep.

The girl and Dunn have a 3 year old kid. No NBA no big child support payday. The NBA will forgive a lot but breaking a girls jaw is a BIG red flag. It will be interesting to see how the facts play out here.
 
We all know how this works for the team's star. Especially in most college towns' law enforcement (other than Norman's nazi police force). There will be some legal shenanigans and this will be downgraded to a misdemeanor or dismissed as a mistake.

Cynicism comes so easily in this world.

Baylor preseason All-American guard LaceDarius Dunn has been suspended indefinitely following his arrest on felony assault charges Tuesday. Dunn is accused of causing “serious bodily harm” to his longtime girlfriend during an altercation last week.

The victim, however, does not want to pursue legal action and is upset with the severity of the charges.

“She feels re-victimized,” said Jason Darling, the woman’s Waco-based attorney.

Dunn, 23, was notified of the charge Tuesday. He turned himself in during the afternoon and was booked into the McLennan County Jail. Dunn was expected to be released a few hours later after posting a $12,500 bond.

Dunn faces between two and 20 years in prison if convicted of the second-degree felony. His sentence could also be lessened to probation, according to his attorney, Vik Deivanvyagam.

According to Darling, Dunn struck his girlfriend in the face during an argument on Sept. 27. He said the punch fractured the victim’s jaw in two places but didn’t cause any loose teeth or bruising.

Darling said she underwent a “minor surgery, a day surgery” at a local hospital.

“There were two small fractures to her jaw,” Darling said. “Her mouth isn’t wired shut. She’s allowed to eat. She can talk. She’s doing everything normal.”


Darling said the woman, 22, has dated Dunn since junior high school and is the mother of his 3-year-old son. Darling said she refused to give a statement to police when they arrived at the hospital that evening. When authorities contacted his office later that week, Darling informed him the woman didn’t want to pursue any charges.

“We were surprised when we found out today that it was a felony arrest,” Darling said. “We didn’t feel that her injuries rose to that level. If anything we believe it was misdemeanor bodily injury.

“We talked to members of the District Attorney’s office about the nature of the injuries. Their felony prosecutors informed us they didn’t think it was a felony offense but Waco police went ahead with the charge.

“She’s upset today because she didn’t think it would get to this level. She didn’t want any of this spotlight or media attention. They got in an argument that escalated too far and he [hit] her one time. It was one punch. Not three or four. He’s been very remorseful and apologetic to her ever since.”

Darling said the victim has returned to her hometown of Monroe, La.

Baylor coach Scott Drew said it would be inappropriate for him to comment until he gathers more information.

A 6-foot-4 senior guard, Dunn averaged a team-high 19.6 points last season for a Baylor squad that finished 28-8 and lost to Duke in the Elite Eight. Dunn is 451 points shy of becoming Baylor’s all-time leading scorer and is also on pace to set the Big 12 scoring record.

Darling said Dunn’s legal future is unclear.

“Even though he was arrested for a felony, it doesn’t necessarily mean he’s going to be formally charged with a felony in the court system,” Darling said. “[The victim] will probably fill out an affidavit of non-prosecution or write a letter to the D.A.’s office that she doesn’t want to pursue any charges.

“At that point it will be up to them whether to pursue the charges or not, but it’s going to be hard to prove a case without a witness.”

The charges will ultimately be dropped with no witness, and he'll probably miss one game against East Popcorn State.
 
I'm sorry, but you don't "accidentally" break both sides of your jaw. The doctor has already stated that she suffered fractures to both sides of her jaw, and that they had to perform "emergency" surgery. Emergency surgery is not minor surgery. LD is guilty on this one. Even with his gf and her family's statement, DA's in Texas are very aggressive in pursuing charges against domestic abuse. IMO, anyone who defends LD in this situation and tries to sweep it under the rug and make it go away is a POS.

no, not really. her lawyer's initial press release/statement thing said that he hit her in an argument. however her own statement says that it was an accident (it actually technically denies that he even hit her, but i think that was just poor wording).

she also denies that her jaw was broken, btw. which i would think might impact either her credibility or that of the doctor and police officer's.

Before this gets to out of hand like some things on the board, I am in no way defending Dunn, I am genuinely interested in how the law is enforced when there is prior testimony and medical proof to abuse but she wont press charges.
 
Can the DA's Office pursue charges based on the Dr.s Testimony since she is now unwilling to press charges?

I'm not a lawyer, but the answer is almost surely yes. It's the state, not the victim, that decides whether charges are pressed, although they could take her wishes into consideration I suppose.

The lawyer's jargon about a "minor surgery, a day surgery" is completely ridiculous to say, there aren't many surgeries that last more than a day. I'm not a doctor, but if she had to get two plates put into each side of her mandible to stabilize the jaw and she was hit hard enough to cause a "comminuted fracture" that is a serious force directly to the jaw. Comminuted fractures mean the bone has broken into a number of pieces.

Oh and did anyone else notice the Waco Police Department affadavit still has 200_ for the year entry? And the policeman wrote in "0", meaning year 2000? Is it so hard to update the freaking forms? Seems like grounds for a mistrial lol.
