This makes no sense. You can't beat someone when you disagree with their speech. Clearly any and all types of private retribution is not allowed

But you can be fired for telling your boss to stick it where the sun doesn't shine, athletes lose endorsement deals for saying stupid things, etc. The government cannot arrest you for saying those things, but that doesn't mean your speech is without consequences.
 
Desmond Mason was just on ESPN and pretty much said those of you that think the fans words matter are wrong. He said people said racist things to him during games. He said you get hit, pushed, and otherwise given the business when you fall in the stands. It is simply part of the game and never justifies touching a fan

Agreed. Smart should be suspended and I don't see how the Big 12 will set aprecedent by not suspending because it will allow other athletes to enter the stands and go after fans.
 
Free speech is not an absolute. There are laws against libel and verbal harassment. The latter tend to be regarded more seriously if applied to race, gender, and other such differences. Since most are state laws, the consequences vary by state.

How is a school's fans frequently using the N word and no one has heard about it before now? The same fans that are at Lubbock are at Texas, OSU, and OU......

The fan has a right to say what he wants, he DOES NOT have the right to attend TT games.

Fans scream obscenities at basketball games and the universities due nothing. Once they establish that precedence they really have a tough time saying F&@ker is allowed but N$&@er is not.

I do not think fans should scream racial slurs but I do think fans have that right. The appropriate response is the surrounding fans to shun and silence the seaker

Denver validates a well known rule of thumb. When most people reference the constitution or founding fathers to justify their position it's usually a tell they have no idea what they are talking about.

That isn't a state action, but the ability of the school to restrict him from attending future games. You going to argue that is illegal? Because it isn't, as schools and the NCAA have banned boosters from affiliating before and will continue to do so when they deem necessary.

Guess we will see how this plays out.

Again, the punishment should be determined by what was said. Any prosecutor or court of law would consider what was said in any potential assault case.

It looked to me like Smart said something and the pushed him when he responded. So....do we get to consider what Smart said to him? I am sure he was not discussing the price of gas. If he did reply to the initial words from the fan with profanity or vulgarity then what? He should have taken the hand up the fans were giving him and walked off. He helped make it worse that would be taken into account too would it not?
