Marcus smart just hit a fan!

Stop trying to turn this thread into a race issue. If anyone on this board thinks it's okay to insult a person of color with words or in any other manner, they're in the minority by far. They're also wrong. So are you for continuing to push your liberal views on everyone.

So it's me turning this into a race issue. Not the white trash clown who called Smart something racial that offended him enough to respond physically. Got it. Smart should be a good little boy and just take it.

The more I think about it the precedent the Big XII should set is that if this guy said anything racially offensive the league should do nothing to Smart. He shouldn't have to tolerate that ignorant nonsense ever. Period.

Bocabull defending Marcus Smart. Has hell froze over?

That dude has been videotaped at least twice of violating this fans code of conduct. If I'm Texas Tech, I'm asking this fan to move to a less focal seat in the arena

Nothing I've seen in the videos is bad

Desmond Mason disagrees.

No, Smart doesn't have to tolerate that ignorant nonsense. He is free to respond just the way he did and suffer the consequences. Or, walk away and suffer no consequences. The choice was his. He may regret his actions or he may think it was worth it.

"Go back to Africa" is that white trash clowns way of saying black people don't belong in the USA. Ignorant white trash is the lowest form of scum on the planet and the US has way more than our share.

Some people need to re-take 7th grade civics, this is not a free speech issue.

When people start saying a State institution like Texas Tech has a right to take action based on the content of speech it is a free speech issue. I don't like racist speech but the issue is not racism. The issue is a content based restriction on speech.

Virtually no one agrees with that church in Kansas and they won at the Supreme Court 9-0.

But tech as the right to not le him come to games. He agreed to that when he bought the tickets

I strongly disagree. Tech sells tickets to the public. They should not be allowed to exclude people based on speech. Now if every tech fan wanted to respond wit go home racist ass chants, I would be fine with that.

Could Tech kick an OU fan out for saying Tech sucks?

So if a student at TT curses out his instructors and calls them racist epithets TT isn't allowed to expel that student because of "free speech", see how ridiculous that sounds?

I'm not a lawyer. But, I do know that you can not contract away your rights. They could print not responsible for accidents on the back of the ticket and put up signs saying not responsible for accidents. But, the venue is always responsible for accidents if in any way negligent.

Freedom of Speech only ptotects you from being arrested or fined by the government for the things you say, to a point. That isn't the situation in this case.

Why would you think that I don't know that? My point is that things printed on the back of a ticket don't mean much and may or not be enforceable.

Take 15 Denver and come back to us. People have the right to spread hate speech at a Bball game? You're crazy.

Actually you are crazy saying they don't. Do you really want to live in a society where the government decides what you can and cannot say? What happens when it is your speech that is silenced?

If person a can pass out a flyer that says cheer loud person B likely has the right to pass out vile hate speech.

Of course it's enforceable, being at the game is a privilege, not a right.

Not inside the confines of a sporting event. Have you ever wondered why the Westboro Baptist idiots only protest OUTSIDE sporting events? Because they aren't allowed to do that inside.

This is a gross understatement of the law. Free speech prohibits state action that restricts virtually any form of speech including speech that we find offensive. There are some limited exceptions such as screaming fire in a theater, fraud, or defamation. However even in these settings our Courts are protective of the speaker.

As a result Larry Flint may publish a vile parody about Rev fallwell, those freaks in Kansas May protest funerals and people may lie about serving on the military.
