that video makes it pretty clear that he says "piece of crap" and you can even hear "piece of crap". Not sure where they find a disagreement.
 
Here's a video that some are saying is proof that Orr uttered "I'm sorry about that" just prior to being shoved.

For Smart, it really doesn't matter that he was provoked. I doubt that any potential provocation will be considered in his punishment. He did commit an act of physical assault when he shoved the fan. It is as simple as that.



Now, as to the fan. There is such a thing as verbal harassment. This doesn't appear to be a case of libel. But, he did say something to Smart. We don't know whether or not it was racially relevant. We don't really know if what he said would constitute verbal harassment. Unless someone can be a witness to what is said, we may never know.



There is a potential problem that he does face. Verbal harassment is considered more serious if there are prior incidents. ESPN has shown him harassing A&M players. Would that be considered a prior incident?



It also reflects on the university, and the university is charged with upholding community standards. They can expel a student or dismiss a fan from the stadium on the basis of behavior. Whether the fan or student takes it to court, and what the court would do with such a charge is up to the court.

Agreed, you hear piece of crap, but there is no proof that it was Orr who said it. Honestly, it wouldn't surprise me that when Tech officials went through all the game video and found this clip, they told Orr that this was his story--to tell everybody he called Smart a piece of crap.
 
The Westboro case gives this fat racist hick the right to stand outside the arena with a "go back to Africa" sign.

Texas Tech has every right to refuse him entry into the arena since there are multiple instances of him causing trouble. Anybody with even the slightest knowledge of the law understands this simple distinction.

Westbrook has nothing to do with the right to publicly protest. That case went to the Supreme Court to decide if an intentional infliction of emotional distress verdict could stand against a articulately repugnant political protest held on public property within the vicinity of a private event.

Really? Seems kind of silly to think the Smart knew that guy's name before all this happened, doesn't it?

I believe that Smart said that he was called the n word. I can even buy the theory that he thought he was called that. But as yet, all the evidence says otherwise. Either prove it or stop with all the racial stuff.

You're correct, he didn't know his name, but he was pointing at Orr while saying that and walking back to the bench.
 
I don't know that the video changes much.



Smart didn't react well, no matter what was said.



It doesn't say much about a fifty-year-old fan that he would insult a college kid to his face.



Incidentally, you don't have to use a racial term for it to be racial. There is simply no evidence in this case whether race played a role or not.

Yes because the worthless liberal says so. You truly make me sick. Two people tell different stories and there is audio evidence to support one side but you dismiss that evidence because it doesn't match you liberal narrative.

That quote is total bull****. First as was pointed out he could not have said Orr because he didn't know Orr's name. Second I am not familiar with a black guy saying he called me the N word.

When you claim to have a quote and two things are highly questionable I tend to think the quote is BS

Exactly. The guy admitted he went too far instantly but said it wasn't racial. A recording confirms his story. If the guy is a liar he is both highly intelligent and extremely lucky.
 
I wonder if Dick Vitale is going to appologize about his comments. It appears prettyclear that Smart lied about what was said
 
For those of you that still think Orr said something worse, or that the audio is doctored, I ask you this.....

Do you really think Smart's first words today at the press conference would have been "I'd like to apologize to Mr. Orr" if Smart or OSU thought for one second that there was some kind of cover up? That is just laughable. If you watched the press conference, you could tell from what was said, how it was said, and what wasn't said, that the whole "n-word stuff" was completely made up. Period.
