that video makes it pretty clear that he says "piece of crap" and you can even hear "piece of crap". Not sure where they find a disagreement.
For Smart, it really doesn't matter that he was provoked. I doubt that any potential provocation will be considered in his punishment. He did commit an act of physical assault when he shoved the fan. It is as simple as that.
Now, as to the fan. There is such a thing as verbal harassment. This doesn't appear to be a case of libel. But, he did say something to Smart. We don't know whether or not it was racially relevant. We don't really know if what he said would constitute verbal harassment. Unless someone can be a witness to what is said, we may never know.
There is a potential problem that he does face. Verbal harassment is considered more serious if there are prior incidents. ESPN has shown him harassing A&M players. Would that be considered a prior incident?
It also reflects on the university, and the university is charged with upholding community standards. They can expel a student or dismiss a fan from the stadium on the basis of behavior. Whether the fan or student takes it to court, and what the court would do with such a charge is up to the court.

Texas Tech has every right to refuse him entry into the arena since there are multiple instances of him causing trouble. Anybody with even the slightest knowledge of the law understands this simple distinction.

I believe that Smart said that he was called the n word. I can even buy the theory that he thought he was called that. But as yet, all the evidence says otherwise. Either prove it or stop with all the racial stuff.

Smart didn't react well, no matter what was said.
It doesn't say much about a fifty-year-old fan that he would insult a college kid to his face.
Incidentally, you don't have to use a racial term for it to be racial. There is simply no evidence in this case whether race played a role or not.
